Our terms and conditions

Welcome to Propana, LLC ("Propana," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our propane tank delivery services and website (the "Services"). By placing an order or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

Propana delivers grill propane tanks, offers tank exchanges, new tank purchases, and subscription services throughout the Northeast region (New Hampshire, Massachusetts, Maine, and Vermont).
3. Eligibility
There is no minimum age requirement; however, by using our Services, you affirm that you have the authority to enter into these Terms.
4. Orders and Payments
All payments must be made upfront via our website using a credit or debit card processed through Stripe.
Subscription services are available on a monthly, bi-weekly, or weekly basis and may be canceled anytime by the customer.
By placing an order, you authorize Propana to charge your provided payment method for the full amount due.
5. Delivery Terms
Standard delivery is next-day, depending on available time slots.
Express delivery guarantees next-day arrival by 9 AM if selected.
Deliveries are made to accessible, outdoor locations; customers are not required to be present at the time of delivery.
6. Risk of Loss and Ownership
Ownership and responsibility for tanks transfer to the customer upon delivery. Propana is not responsible for lost, stolen, or damaged tanks post-delivery. Customers are encouraged to secure tanks promptly.
7. Safety and Customer Responsibilities
By placing an order, customers affirm they will handle propane tanks safely and according to industry best practices.
Propana disclaims any liability for misuse of propane tanks.
Customers must not tamper with, resell, or improperly store propane tanks.
8. Cancellation and Refunds
Order Cancellations
You may cancel your Propana order at no cost if the cancellation is made before 6:00 PM the day prior to your scheduled delivery date.
Cancellations after 6:00 PM the day before delivery will incur a $10 late cancellation fee.
Cancellations made after the delivery driver is en route will incur a $25 in-transit cancellation fee, as your order is already in progress.
If your delivery is missed due to lack of access or incorrect instructions, a $25 missed delivery fee may also apply.
All fees will be deducted from your original payment. By placing an order with Propana, you acknowledge and agree to these terms.
Refunds
Refund requests outside of the cancellation policy will be evaluated on a case-by-case basis at Propana's sole discretion.
9. Intellectual Property
All trademarks, logos, and content on the Propana website are the exclusive property of Propana, LLC. Unauthorized use is prohibited.
10. Promotions
Promo codes and discounts may be offered and are subject to expiration and additional terms provided at the time of issuance.
11. Updates to Terms
Propana reserves the right to modify these Terms at any time without prior notice. Changes will be effective immediately upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
12. Force Majeure
Propana shall not be held liable for delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to natural disasters, labor disputes, or governmental actions.
13. Account Termination and Deletion
You may request deletion of your Propana account at any time through the account settings page or by contacting our support team. Upon receiving a deletion request, Propana will:
- Immediately disable your access to the account.
- Begin a 30-day retention period during which your account data will be marked for deletion but not yet removed, in case you wish to recover your account.
- After the retention period, delete or anonymize your personal information in accordance with applicable data protection laws and internal data retention policies.
Please note:
- Propana may retain certain transaction records, such as order history and payment logs, for legal, regulatory, accounting, and operational purposes. These records will no longer be associated with your personally identifiable information where feasible.
- Propana reserves the right to suspend or terminate your account without notice if there is a suspected violation of these Terms of Service, fraudulent activity, or abuse of the service.
- Once deletion is finalized, it cannot be undone.
14. Dispute Resolution and Governing Law
Any disputes shall first be resolved through binding arbitration rather than litigation in court.
These Terms are governed by the laws of the State of New Hampshire.
You and Propana waive the right to participate in any class action or collective action.
15. Liability and Indemnification
You agree to indemnify and hold harmless Propana, its employees, officers, directors, contractors, and affiliates from any claim, liability, loss, damage, or expense (including attorney's fees) arising from your use or misuse of our Services or propane tanks.
Propana shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
17. Notices
All communications from you to Propana must be sent to support@propana.co. All communications from Propana to you will be sent to the email address you provided during checkout.
